Gift Card Terms and Conditions

By placing an order for purchase of gift cards, or using a gift card code to pay for part or all of an order via this website you are agreeing to the terms conditions set out below.

General Conditions

These conditions apply to use of the following product:

  • Boat Accessories Australia Gift Card issued by Boat Accessories Australia Proprietary Limited ACN 144 721 586 (BAA)

References to “we, us, our” in these terms and conditions are to BAA, as indicated on the gift card you hold. BAA may, in its complete discretion, refuse to sell gift cards to any person at any time for any reason. Purchasing or using the gift card means that you accept the terms and conditions of this agreement.

If you let another person use your gift card, you must tell them that they will be bound by these terms and conditions. Western Australian (WA) law applies to this agreement. By entering into this agreement, you unconditionally submit to the jurisdiction of the courts of WA.

Gift cards and codes are individually created and emailed to the purchaser by our staff Mon – Fri within Western Australian business hours.  If your order is placed outside of business hours, the gift code will be emailed to you the next business day.

Gift cards will be issued within 1-2 business days of purchase. Gift cards cannot be redeemed for cash, cannot be used for cash equivalent transactions (such as bill payments, purchase of financial products or foreign currency, or gambling transactions), reloaded, returned for a refund or have their balances consolidated to a new gift card. We may in our sole discretion elect to cancel a gift card or block such a transaction if you attempt to do so. Gift cards are not legal tender, account cards, credit or debit cards or securities.

If you have a query or complaint about the gift card, please raise it through any of our contact channels (listed below). Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by law, our liability is limited to replacing faulty gift cards.

If you think there has been a mistaken transaction on your gift card, please contact us.

We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card. The gift card remains our property.

We can vary or replace these conditions from time to time (including to introduce new fees) by publishing a notice on www.boataccessoriesaustralia.com.au at least 30 days before the change. The current version of these conditions is available through our contact channels.

Gift cards and codes are valid for one year from the Date of Issue. After the gift card has expired, it is no longer valid and all transactions will be declined. Unused value may not be refunded and may become our property.

Orders

You may place an order by following the instructions on www.boataccessoriesaustralia.com.au.  Your order will be submitted when you complete your payment details and indicate your acceptance by activating the "Confirm Order" button. Orders will be deemed to have been received by us at the time we send an Order Confirmation to your registered e-mail address.

You must use a valid email address. One valid address per customer is permitted.

Each order (once accepted) represents a separate agreement incorporating the terms of that order, including these Terms and Conditions.

You may place an order for up to 5 Gift Cards in one order, with a total value not exceeding A$1,000. A minimum value of $20 and a maximum of $200 can be loaded on each Gift Card. We may change the minimum and maximum amounts that can be loaded onto a Gift Card from time to time at our sole discretion. To purchase more than 5 Gift Cards or to make an order for an amount exceeding $1,000, please call us on 1300 308 161.

Discount and promotional codes cannot be applied to purchases of gift cards.  Gift cards cannot be used to purchase another gift card.

We reserve the right to not accept orders, including those for commercial quantities of gift cards. If we are unable to supply your total order, we will endeavour to contact you to discuss whether you wish to proceed with the part of the order.

We reserve the right to cancel any order at any time, without notice, for any reason.

If you wish to cancel an order, you must immediately notify us on 1300 308 161 during Western Australian business hours, quoting the order number. Orders that have already been processed cannot be cancelled. Where possible, we will endeavour to process cancellation requests and provide you with a refund, but we will not be liable for any failure to do so.

You acknowledge that the internet can be an unstable and, sometimes, insecure marketplace. At times, our website may not be available; your login or password may be disabled, suspended, cancelled or expired; or orders may not be processed or may not be accepted for reasons beyond our control. In these circumstances, we accept no responsibility. We do not warrant and cannot ensure the security of any information transmitted, or a person on your behalf transmits, to us. Accordingly, any information which you transmit to us, including your credit card details, is transmitted at your own risk and we are not responsible while such information is in transit. The Australian Government has published information about protecting yourself in online transactions (that website is not provided by us).

Payment

Payment for orders is to be made by:

  • Visa or MasterCard credit cards or
  • PayPal; or
  • Electronic Funds Transfer

Where you have elected to pay for your order using:

A credit card, we will process payment for your order once you click on "Confirm Order", plus any delivery charges, an applicable credit card surcharge and service fees as itemised on the final screen which indicates your acceptance of this contract (Total Amount) using your nominated credit card via a secure payment gateway. You authorise us to debit the Total Amount from your nominated credit card. If your nominated credit card is declined by your financial institution, we will not be required to fulfil the order, and may contact you to make alternative payment and delivery arrangements.

PayPal, we will process payment for the Total Amount of your order once you click on "Confirm Order" on the final screen where you indicate your acceptance of this contract. Where you use a PayPal account, you are bound by the PayPal terms and conditions in addition to these terms and conditions. In the event that there is a conflict between these terms and conditions and PayPal’s terms and conditions, these terms and conditions will prevail to the extent of the inconsistency.

Electronic Funds Transfer, you will be provided with our bank account details at the time of placing your order. You must include your order number with your bank transfer otherwise your order may be delayed.

We may decide at any time not to accept payment from you for any reason. If we decline to accept payment, we will not process the order and may not contact you to inform you that your order will not be processed. We will not process any order until the payment has been received and will not be liable for any delay from banking delays or misdirected payments.

Delivery

Gift Cards are only available for email delivery to the purchaser’s registered email address. It is then the purchaser’s responsibility to either:

  • Forward on the gift card to the recipient by email
  • Print out the gift card and give to the recipient by hand

Boat Accessories Australia does not currently have the facility to send gift cards directly to recipients by email or post.

Gift cards are individually created and emailed to the purchaser by our staff Mon – Fri within Western Australian (WA) business hours.  If your order is placed outside of WA business hours, the gift card will be emailed to you the next business day.

We will not be liable to you or anyone else for any losses suffered or incurred due to delay in delivery or for any non-delivered gift cards, including any gift cards not delivered to the purchaser’s or recipient’s email address as a result of typos, internet connection or email problems or any other technical issue out of our control.

Use of Gift Cards

Gift cards may be used to purchase goods only on www.boataccessoriesaustralia.com.au where the gift card has enough value to make the purchase.  The gift card code must be entered in the ‘Coupon Code’ field during the checkout process in order for the value to be redeemed.

Gift card codes are single-use only, and BAA does not currently have the facility to store any unused gift card value as credit.  We recommend using the full value of the card in a single transaction as any unused value will not be available for future use.

Gift cards will be issued within 1-2 business days of purchase. Items costing less than the value of the gift card will subtract the amount from the gift card, however because BAA does not have the facility to store unused credit on the site it will essentially be forfeited.

If the purchase is greater than the value of the gift card, the entire balance of the gift card will be subtracted and the customer will be asked to provide another form of payment to make up the difference such as cash, credit card, debit card etc.

Keep your gift card secure and treat it as you would treat cash, as anyone who has the gift card code can use its value to make a purchase. If your gift card is lost or stolen, or you suspect an unauthorised transaction, immediately report this by calling 1300 308 161 (during West Australian business hours). We may be able to stop the gift card value being used, but require you to provide your identity as the purchaser, and provide details of the original order including the registered email address.

We may replace a non-delivered or lost gift card. Any replacement gift card will have the same unused value (at the time of replacement) and expiry date.  Contact us about this on 1300 308 161 (during West Australian business hours). You must prove your identity and provide the details of the original order for the gift card, including order number and registered email address. Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks at our absolute discretion.

IMPORTANT: GIFT CARDS WILL EXPIRE ONE YEAR AFTER THE DATE OF ISSUE.
